The common CE mark directive should be modified twice:
91/368/EEC
98/37/EC
Basically, the regulation only enlarge the range of machinery and change the transition period of some equipment and CE mark itself.
What is machine?
In accordance with the provisions of Directive (Article 1.2), it’s a combination of components. At least part of the purposes are processing raw materials, packaging or handling, and through appropriate actuators, controllers or circuit and movement. These are referred as [machine].
[Machine] contains the machines and control groups to achieve the integrated functions of same raw materials processing, handling and transportation to move, packaging and other arrangements. In addition, a number of parts to guarantee safety, and if failure, it will be exposed to endanger the safety or health of the [security components]. It is also included in the broad sense of machinery.
Mechanical products which do not belong to the scope of the directive ?
In accordance with the provisions of Directive, the following products don’t belong to the machinery of the scope of the directive (Article):
Design and manufacturing equipments for up-and-down and / or transport, whatever load or not, except industrial trucks for the up-and-down equipment operators.
Human power is the direct power of the machinery, unless the machinery used for high pile of goods.
Medical machinery contact with the patient directly.
Special equipments use for piazza or amusement park.
Steam boilers, trough and pressure vessels.
Specially designed or application machinery use for nuclear energy, the accidents can lead to radiation leaks.
Radioactive components of a machine part,
Light weapons.
Storage tank and distribution pipeline for petrol, diesel, flammable liquids and hazardous materials,
Carriers: are those transport personnel and / or cargo carriers and trailers by road, railway, waterway and air, and the public transport network. However, the vehicles used for mining industry are contained in this directive.
Ships equipped with related equipments, and mobile offshore equipment.
Transport for public or private, manned cable car and hanged with rope.
Hoisting machine used for forest, as detailed instructions in Communique Directive 74/150/EEC Article 1, paragraph 1 (1), is about the relevant directive of reconcile wheeled agricultural or forest hoisting machine in European cities, the directive finally modified by Communique Directive 88 / 29/EEC Directive (2).
The machinery especially designed and manufactured for military or police.

In addition, the risk of machinery or security o equipment in directive 392 is, if all or part of the EU directive covered by the rest, and subjected to the application of these directives, this directive will not apply or have to stop apply to these products.
